Third District Court Commissioner Announced

Salt Lake City, UT---Third District Juvenile Court Presiding Judge Kimberly K. Hornak and Third District Court Presiding Judge Sandra N. Peuler have appointed Michelle C. Tack as a commissioner in the Third District Court effective July 28, 2006. Tack was selected based on a majority vote of the Third District and Juvenile Court judges. The Third Judicial District is comprised of Salt Lake, Summit, and Tooele counties.

Tack came to the courts from the Utah Attorney General’s Office where she worked from 1999 to present. From 1993 to 1999, Tack ran a general litigation practice that focused on family law. Tack received her law degree and a Bachelor of Arts degree from the University of North Dakota.

Court Commissioner is a quasi-judicial officer as provided by the Utah Code and the rules of the Utah Judicial Council. The commissioner will assist the Third District Court with domestic and mental health cases and the Third District Juvenile Court with minor delinquency matters.

Chief judge

Definition:
A chief judge is appointed by seniority and has primary responsibility over the administration of the court and decides cases at the same time.

Subpoena duces tecum

Definition:
The subpoena duces tecum refers to the command to a witness to deliver documents.

En-banc

Definition:
Court sessions with the whole membership present rather than the usual quorum is called en banc or ?full bench?. U.S. courts of appeals participate in panels of three judges and are then said to be sitting en banc.
